I got rear-ended by a girl who was texting. I was stopped, and she slammed into the back of me at 45 mph. I flew forward even though I had my seatbelt on. I had neck muscle spasms and neck and back pain. I have two herniated discs in my lower vertebra, and my insurance company settled before I could cover the physical therapy and chairopractor costs. I have to live with back pain the rest of my life. Insurance companies can also screw you over too.
 
Sorry to see that on a new truck. Glad to see that everyone is OK.

Last week I was stopped at a stop light at the end of an exit ramp.

The light turned green and some j*ck *ss ran the red light and took out the left fender, hood front clip and right fender of my car. No one was hurt.

The insurance adjuster said they can bend the frame back on a frame straightener and repair the car to pre-existing conditions.

But I know that if I sell this car that everyone who runs a CarFax will know that the vehicle had a collision.

It is a "lose - lose" situation.
 
Man, that's aweful. But like everyone else said - stuff can be replaced; people can't. Hope all fully recover quickly. At least a Lexus owner is likely to have decent insurance.

Nine years ago, my wife was rear-ended by an 'undocumented worker' in a K5 Blazer and pushed into a Honda Civic in front of her. Neither driver had any insurance nor spoke any English. We did. Fortunately, the police found out the Blazer was owned by somebody who 'employed' the worker and had coverage. It took quite a bit of effort to get things headed in the right direction, including a visit to the judge, because the Honda driver sued us. We had only had my wife's vehicle 3 weeks as well. Even with a $14k repair bill (originally estimated at $8k), it wasn't totaled, so we basically had to drive it til the wheels fell off before finally purchasing a new vehicle last year.
 
That really sucks. Glad you guys are ok.

Man! Thank goodness you weren't out in the TA!
That is what my wife and i said. If we had been then there would be no doubt it would be totaled and we would probably be in the hospital.

sucks about the truck, but I'm glad everyone is OK.

also glad it wasn't the firebird.

if it is totalled, mention to your insurance agent that you just had the rhinolining done. they should reimburse the full amount. our LT1 roadmaster had a full tank of gas and they gave us another $60 when it got totalled.
Yeah we had just filled the tank with gas, put the tires on it two weeks earlier and the bedliner sprayed in a couple of days later. We have receipts for all of it.

The anticipation is kiiling me. I just want to know the future of my vehicle.

I am fuming right now. I just got off the phone with the adjuster. They are totaling out the truck. They offered us less than we paid for it just two months ago. We paid $1000 under Blue Book and NADA values for it and we just spent $1300 on a bed liner and tires two weeks ago. That is not counting the taxes and fees with registering a new vehicle. It is not my fault their client ran into me. I was abiding the law and expect nothing but enough to buy another truck in equal size, shape, and condition. Am I asking too much!!!!!
 
I'm sorry to hear that. That's exactly why I HATE insurance companies! They screw you over. You do nothing wrong and their stupid client hits you, and you have to suffer because of it? I think that's bull. You are definitely not asking too much.
 
Maybe you could contact an attorney. That's what I would do. There's no dispute on who's at fault here. Why should you be short changed and be required to take less than what it would cost to replace the truck.

That is the way I feel about it as well. I will not settle for less than what I am due. With an offer that low and the data i have already collected, I don't think it would be hard for me to prove the value of my vehicle. Tomorrow I plan on giving them an ultimatum. If they can't meet it then I guess to court we go.
 
Yeah, I would contact an attorney and have him/her give the insurance company a call. My 86 was hit by the trash truck company the day after I bought it. It was parked in front of my house. Their insurance people tried to total out my car. The damages were estimated at 2400, no frame damage or anything. I told them i'd sue the trash company and the insurance company. 3 weeks later I got a check in the mail for 2400 and the car wasn't reported as totalled.

Well after talking with my wife and friend I am feeling a little better about things. I am beginning to realize that thanks to Florida being a "No Fault" state that no matter what I will be loosing money on this deal. I am though beginning to believe that I shouldn't have a problem getting them to agree to my bottom line so at least I can find a comparable vehicle. Still waiting for their second offer. I will let you know how it goes.

I stuck to my guns and used some internet research to make arguments. We finally settled on what I feel was a fair amount and will soon be able to look at getting a replacement vehicle. I am glad I looked up the laws for what is considered a "Comparable Vehicle". One of the stipulations is that the vehicle must be within a reasonable distance from your house for inspection by you, the other was that the vehicle had to be in as good if not better condition then the vehicle it was replacing. All the vehicle examples for sale they sent me included no pictures, were missing lots of options, and only 4 of the 10 were within 300 miles of my house. They insurance adjuster took pity on me and actually awarded me a few hundred more than I was willing to settle for. Finally things are starting to work out.
